§1 General provisions
These Regulations set out the rules for the use of the ArtLounge+ online platform (hereinafter referred to as the "Platform"), operated by the company Next Wave Global LLC with its registered office at : 30 N Gould St Ste R, Sheridan, Wyoming, zip code: 82801, USA (hereinafter referred to as the "Owner").
Users of the Platform may be natural persons who are at least 18 years old and have full legal capacity (hereinafter referred to as the "User").
The Platform is a place where all registered Users have access to free content presented on the Platform, while registered Users who have ordered and paid for a selected subscription have access to certain digital content or materials made available for a fee for the duration of the subscription.
Use of the Platform is tantamount to acceptance of these Regulations.
§2 Registration and logging in
In order to use the Platform, a User must create a User’s account by providing his/her name and email address.
The creation of an account is free of charge.
The account is created for personal use only.
In order to log in to the Platform, the User must enter his/her e-mail address and password, which he/she established during registration.
The User undertakes to provide true and current data and to update it in case of change.
The User is responsible for maintaining the confidentiality of his/her password and agrees not to share it with third parties.
The scope of paid content available to a registered User depends on the subscription purchased in accordance with the offer in effect on the Platform website at the time of subscription purchase.
The Owner reserves the right to change the subscription offer and introduce promotions.
The fee for the use of paid content in the form of a purchased subscription shall be determined according to the Owner's price list current as of the date of conclusion of the respective subscription agreement. The price list of fees current as of the date of conclusion of the subscription agreement by the User is posted in the offer section on the Platform.
Subscription prices are expressed in the currency specified by the Owner. Payments for subscriptions are made through payment service providers selected by the Owner.
Subscriptions are not automatically renewed.
§4 Conclusion of the subscription contract, complaints and withdrawals.
The subscription agreement shall be concluded upon confirmation by the Owner of the User's completion of an order for a given subscription. Confirmation of the order for a given subscription shall be received by the User no later than upon payment for the selected subscription.
The content of the agreement shall be the provisions of these Terms and Conditions, as well as the terms and conditions stated during the purchase process.
The duration of the subscription and the scope of content covered depend on the type of subscription purchased in accordance with the offer in effect on the Platform at the time of subscription purchase.
The User may change the type of subscription at any time, subject to the terms and conditions set forth in the subscription offer and these Terms and Conditions.
If the Owner fails to provide the benefits of the subscription agreement, the User has the right to make a complaint. The complaint should be submitted in writing to the Owner's address: email@example.com within 14 days of the occurrence of the problem. If the complaint is accepted by the Owner, the User has the right to change the subscription or refund part or all of the amount paid. The complaint processing time is up to 14 days.
The User may withdraw from the subscription contract without giving any reason within 14 days from the date of its conclusion.
To exercise the right of withdrawal, the User must submit a written statement to the Owner's address: firstname.lastname@example.org. attaching a properly completed withdrawal form. The form for withdrawal from the Sales Contract is attached to the Terms and Conditions.
In the event of withdrawal from the contract, the Owner shall return to the User all payments received from the User within 14 days of receipt of the withdrawal statement.
The User may not withdraw from the subscription contract if the service has been started with the User's express consent. The subscription contract is concluded for the entire term of the subscription, and it is not possible for the User to terminate this contract with notice before the end of the subscription term.
If the User violates the provisions of these terms and conditions or applicable laws, the Owner reserves the right to suspend or remove access to the Platform and to terminate the subscription agreement without notice.
Any changes to the concluded subscription agreement or the Platform's regulations shall be made in writing, via e-mail or on the Platform.
The provisions of applicable law shall apply to matters not covered by these regulations.
§5 Liability and copyright
The Owner shall not be liable for any damages resulting from the use of the Platform by Users.
The Owner reserves the right to delete a User's account in case of violation of these Terms and Conditions.
All content made available on the Platform is protected by copyright and is the property of the Owner or other entities that have agreed to make it available. The User agrees to use the content only for personal purposes and may not distribute, copy, modify or otherwise use it without the Owner's permission.
The User shall be responsible for all actions taken while using the Platform, including any damages caused by infringement of copyright or other intellectual property rights.
§6 Personal Data Protection
The Owner shall process Users' personal data in accordance with applicable data protection laws, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter "RODO").
§7 Final provisions
The Owner reserves the right to amend these Regulations at any time. Changes to the regulations shall come into force upon publication on the Platform.
In the case of disputes arising from the use of the Platform, the courts with jurisdiction over the seat of the Owner shall have jurisdiction.
These Terms and conditions are effective as of the date of publication on the Platform.
